In August 2024, important changes were made to the legislation on tourist rentals in Spain, which both homeowners and landlords must consider. The main innovations are as follows:
- Rental period restriction: now housing can be rented to tourists for no more than 10 consecutive days. This change is aimed at regulating short-term rentals and improving control over the tourism sector.
- New license validity period: tourist licenses that allow renting out housing are now issued for 5 years. Licenses obtained before August 7, 2024, will be valid until August 8, 2029.
- Mandatory guest registration: from October 1, 2024, there is a requirement to register all guests with the police. This will ensure safety and control over tourist accommodation.
- Ban on room rentals: it is prohibited to rent out individual rooms or exceed the declared number of sleeping places.
- Change of owner: any changes in the composition of owners or users of tourist housing must be timely registered, including license updates.
- Neighbor consent: renting out housing for tourist purposes now requires permission from the residents of your apartment building (community) to confirm that they do not object to tourist activities.
- Compliance with equipment standards: rented housing must be fully equipped and comply with all established requirements for tourist rentals.
- Compliance with safety requirements: properties rented for tourism must meet certain standards. For example, having a sign with the license number, an evacuation plan, and a list of emergency numbers (police, ambulance, taxi, etc.).
- Ban on electronic locks: the use of electronic locks for handing over keys to tenants is prohibited. This applies to locks installed both on doors and outside.
- Fines and liability: violation of the new legislation may result in serious fines of up to 600,000 euros, as well as automatic cancellation of the tourist license.
These changes are aimed at improving control and regulation of tourist rentals, as well as ensuring safety and law and order.
